Bank Sales, Distress Sales – Orangeville, Shelburne, Dufferin County … Foreclosure vs Power of Sale … You read and hear a lot about foreclosures these days. For the most part however, foreclosures do not enter into the equation here in Ontario as this is a legal action seldom taken by lenders. The Coles Notes version; under foreclosure proceedings the lender assumes ownership of the property, and all the obligations that go with it, after a lengthy expensive legal process that includes having to pay Land Transfer Tax. Under Power of Sale, the lender exercises a provision in the mortgage that allows them to sue for possession (as opposed to ownership) and sell on your behalf, a much more cost effective process for the lender. This is why, if you are looking for a U.S. style bargain, you aren’t likely to find it as the lender cannot just ditch the property for what is owing. The lender is selling on behalf of the borrower, not as the actual owner, and has a legal obligation to make every attempt to sell the property for as close to market value as possible. Of course, there are still deals to be had – it’s the nature of the beast. Just don’t be misled by American headlines and expect to pick up a property for a small fraction of it’s value.
